INFORMATIVA PER LA TUTELA DEI DATI PERSONALI AI SENSI DELL’ARTICOLO 13 DEL D. LGS. 196/2003 E DEL REGOLAMENTO 679/2016
In adempimento a quanto disposto dal D. Lgs. 196/2003 e dal Regolamento 679/2016 (di seguito, il “GDPR“), la Società easycharter.it (P.I. 05908991218) con sede legale inVIA LUCA GIORDANO 99 NAPOLI (NA) CAP 80128 (di seguito, la “Società”), in qualità di Titolare del trattamento, rende le seguenti informazioni circa il trattamento cui saranno sottoposti i dati personali relativi alla impresa [?] o del sig. [?] (nel seguito, l’uno o l’altro definiti il “Cliente”) quale persona fisica ed ai dipendenti persone fisiche del Cliente. In tal senso, il Cliente si impegna a trasmettere la presente informativa ai dipendenti con i quali verrà in contatto la Società. Il trattamento dei dati personali sarà improntato ai principi di correttezza, liceità e trasparenza, e verrà realizzato tutelando i diritti e le libertà fondamentali dei soggetti interessati, nel rispetto della vigente normativa in materia di sicurezza e protezione dei dati personali.
1. Finalità del trattamento dei dati
I dati personali saranno trattati per le seguenti finalità:
1. Adempimento di obblighi previsti o derivanti dalla legge (compresa la stipula del contratto e la corretta identificazione del legale rappresentante del Cliente o dei referenti del Cliente), da regolamenti e da normative comunitarie, nonché da disposizioni impartite da autorità o da organi a ciò autorizzati. Il conferimento dei dati personali necessari a tali finalità è necessario e il rifiuto di fornirli comporterà l’impossibilità di instaurare rapporti con la Società;
1. finalità connesse e strumentali alla instaurazione, esecuzione e gestione dei rapporti contrattuali tra la Società e il Cliente e i dipendenti del Cliente. In particolare, i dati personali saranno trattati per eseguire gli obblighi derivanti dal contratto o per adempiere, anche prima della conclusione del contratto stesso, a specifiche richieste dell’interessato. I dati personali potranno altresì essere utilizzati per provvedere agli adempimenti inerenti allo svolgimento dell’attività economica e del contratto ed alle relative operazioni contabili, amministrative, fiscali. Alcune di tali attività potranno essere svolte anche da soggetti terzi a ciò preposti dal Titolare del trattamento. Il conferimento dei dati personali necessari a tali finalità è necessario e il rifiuto di fornirli da parte del Cliente o del dipendente del cliente potrebbe comportare l’impossibilità per la Società di prestare alcuni servizi richiesti o di instaurare correttamente il rapporto contrattuale con il Cliente.
La base giuridica del trattamento è l’esecuzione del contratto di lavoro con il Cliente e l’adempimento di obblighi di legge ai quali è soggetto il Titolare del trattamento.
2. Modalità di trattamento dei dati e conservazione
Il trattamento sarà effettuato mediante strumenti manuali e/o mediante l’ausilio di strumenti informatici, in modo funzionale alle finalità indicate, e tale da garantire, in ogni caso, la sicurezza e la riservatezza dei dati personali, in conformità alle norme che impongono l’adozione di misure idonee a garantire un livello minimo di sicurezza.
All’interno della struttura della Società, il trattamento dei dati verrà effettuato da dipendenti e collaboratori all’uopo designati mediante atto scritto quali persone autorizzate o responsabili del trattamento e tenuti ad operare nei limiti e nell’osservanza delle istruzioni impartite dal Titolare.
I dati verranno conservati per il periodo di tempo necessario previsto dalle legge per esigenze di tipo contrattuale e fiscale.
3. Comunicazione dei dati e ambito di diffusione dei dati
I dati personali dell’interessato potranno essere comunicati a soggetti che, per esigenze aziendali, commerciali o contrattuali, si inseriscono nella distribuzione dei prodotti e dei servizi della Società (es. collaboratori e consulenti esterni, enti istituzionali, istituti ed enti assicurativi, bancari, finanziari, società che si occupano di logistica), consulenti legali. L’elenco completo ed aggiornato dei responsabili del trattamento, nonché degli altri soggetti a cui i dati personali potranno essere comunicati è disponibile presso la sede del Titolare e potrà essere liberamente consultato su richiesta.
1. Diritti dell’interessato di cui all’art. 7 del Codice
In relazione al trattamento dei dati suindicato, Lei potrà esercitare i diritti richiamati nell’art. 13 GDPR 679/16 come meglio espressi negli artt. 15-16-17-18-20-21 e 22 GDPR 679/16 e nello specifico Lei avrà diritto di:
1) ottenere la conferma dell’esistenza o meno di dati personali che La riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile;
2) chiedere al Titolare del trattamento l’accesso ai dati personali, oltre al diritto alla portabilità dei dati;
3) ottenere l’aggiornamento e la rettificazione ovvero, quando vi ha interesse, l’integrazione dei dati;
4) opporsi, in tutto o in parte: a) per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché pertinenti allo scopo della raccolta; b) al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale.
5) ottenere la cancellazione e la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati;
6) revocare il consenso in qualsiasi momento senza pregiudicare la liceità del trattamento basato sul consenso prestato prima della revoca, nei casi previsti dalla legge;
7) proporre reclamo a un’autorità di controllo;
8) ottenere l’attestazione che le operazioni di cui ai superiori numeri 4 e 6 sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato.
